GENERAL TERMS AND CONDITIONS OF SALE

1 – REGISTRATION AND PAYMENT

1.1 Registration

Registration becomes final only upon receipt of the deposit.
In accordance with applicable consumer legislation relating to travel services, the right of withdrawal does not apply to the purchase of travel services provided on specific dates.
Registration for any of our trips implies full and unconditional acceptance of these General Terms and Conditions of Sale.

1.2 Payment Terms for Trip Registration

The validity period of any quotation is 14 days from the date of issue.
All prices indicated are based on the best available rates at the time of quotation and may be modified at the time of booking depending on availability. Prices may also be adjusted due to exchange rate fluctuations or increases in government taxes, which may affect the total trip price.
Any additional costs resulting from modifications requested by the client will lead to a price adjustment (for example: non-refundable airline tickets, hotel changes, additional visits not included in the itinerary, or itinerary modifications).

Deposit and Balance Payment Conditions

For bookings made more than 45 days before departure:

Bank charges related to bank transfers (which vary depending on financial institutions) are the sole responsibility of the traveler.
The balance due will be communicated after receipt of the deposit. Processing time for deposit confirmation may take between 48 hours and 8 days for international SWIFT transfers.
The remaining balance must be paid no later than 45 days before departure using the chosen payment method.
AYURDESTINATION reserves the right, in case of non-compliance with the payment schedule for either the deposit or the balance, to consider the contract cancelled by the traveler and to apply, without prior notice, the cancellation penalties specified in Article 6.

2 – TRAVEL INFORMATION

2.1 Administrative and Health Requirements

Before registering for a trip, traveler's must ensure that each participant holds a valid passport or other travel document that complies with the entry and transit requirements of the destination country.
AYURDESTINATION provides information regarding customs and health formalities for French nationals. It is the responsibility of French travellers to verify that they possess all required documents necessary for travel.
Travelers of other nationalities or with dual nationality must obtain information regarding visa requirements and health formalities (such as vaccinations) from the relevant embassies or consulates before registering.
A traveler who is unable to board a flight due to missing, invalid, or non-compliant documents will not be entitled to any refund.
AYURDESTINATION cannot be held responsible for consequences resulting from failure to comply with administrative, customs, police, or health regulations, including but not limited to incorrect visas, loss of identity documents, or airline tickets.

2.2 Safety and Health Information

For safety information, travellers are advised to regularly consult the travel advisory pages of the French Ministry for Europe and Foreign Affairs before departure:

Travelers are responsible for following the recommendations issued by competent authorities regarding health and safety during their trip

3 – AIR TRANSPORT

3.1 Airline Company

The choice of airline remains the responsibility of the traveler.
The traveler must book flights according to the dates and airport information provided by AYURDESTINATION for the travel program.
Any booking errors made by the traveler are solely the traveler’s responsibility. Any additional costs resulting from incorrect flight bookings or necessary rescheduling of travel services will be charged to the traveler.

3.2 Transportation Arranged by the Traveler

Travelers arranging their own transportation to the trip starting point and back home are advised to purchase flexible or refundable tickets and allow sufficient time between airport or station transfers.
AYURDESTINATION cannot be held responsible for additional costs arising from unforeseen events or third-party actions requiring modifications to the travel services booked with AYURDESTINATION or to transport arrangements made independently by the traveler.

4 – MODIFICATIONS REQUESTED BY THE TRAVELER

Any modification requested by the traveler before or during the trip may incur additional fees.
Depending on the nature of the changes requested, modification fees may reach up to 100% of the trip price, particularly in cases involving non-refundable airline tickets or last-minute accommodation changes.

Travelers may request customised arrangements such as:

Such requests will be processed based on availability and will be invoiced according to the services requested. A revised pro forma invoice will be sent by email 30 days before the traveler’s arrival.
Any modification requested by the traveler will incur an administrative fee of €50.
Refusal to pay this fee will be considered a cancellation, and the cancellation terms described in Article 6 will apply.

5 – TRANSFER OF THE TRAVEL CONTRACT

In accordance with tourism regulations, a traveler may transfer their travel contract to another person meeting the same conditions for participation.
This transfer must be notified to AYURDESTINATION at least 7 days before departure, using any method allowing proof of receipt.
The original traveler and the new participant remain jointly liable for the payment of the trip balance and any transfer fees.
Travelers are advised to inquire about the applicable fees before transferring their contract.

6 – CANCELLATION TERMS AND FEES

6.1 Cancellation Conditions

6.1.1 Cancellation by the Traveler

In the event the traveler needs to cancel their trip to Kerala, for the holiday in Kerala, or the Ayurveda program, they must notify AYURDESTINATION in writing as soon as the reason for cancellation arises.
The date on which the written notification is received by AYURDESTINATION shall be considered the official cancellation date for calculating applicable fees.

6.1.2 Partial Cancellation

If one or more participants cancel their participation while others continue the trip, the price for the remaining travelers may be recalculated based on the updated number of participants.
Refusal to accept and pay the adjusted price will be treated as a cancellation and will be subject to the applicable cancellation fees outlined below.

6.1.3 Cancellation by AYURDESTINATION

If the minimum number of participants required for a group trip is not reached,BKV INTERNATIONAL MARKETING CONSULTANT marketed by AYURDESTINATION reserves the right to cancel the trip without penalty.
Travelers will be informed no later than one (1) month prior to the departure date. In such cases, travelers will receive a full refund of all amounts paid or may be offered an alternative travel date.

6.1.4 Cancellation due to special circumstances

In case of any special circumstances happening at destination in India or hindering flights to India (i.e. earthquake, war, epidemic, air strike, natural catastrophe ….), if clients or AYURDESTINATION have to cancel one reservation by FIT or group, the cancellation policy of the hotel/resort booked for this service will apply. AYURDESTINATION will adjust his policy to the one applied by the hotel, resort, ayurveda center (i.e. refund, partial or full voucher for another trip ..). AYURDESTINATION will deduct all bank and accountancy charges involved by the cancellation and will refund the amount based on the exchange rate of the day of refund procedure.

6.2 Standard Cancellation Fee Schedule

In the event of cancellation by the traveler, the following fees will apply:

Failure to appear at the departure location (no-show) will not entitle the traveler to any refund.
Any trip that is interrupted or shortened by the traveler will not be eligible for a refund.

The total cancellation fees will never exceed the total trip price.

6.3 Partial Cancellation Fees

For organized group trips, if one or more travelers cancel while others proceed with the trip, cancellation fees will apply to:

Expenses not included in the services purchased through BKV INTERNATIONAL MARKETING CONSULTANT (AYUR DESTINATION ) including but not limited to flights, visas, or travel documents) are non-refundable.

Any refund request must be supported by a written Refund Request for Cancelled Trip -

Refunds will be processed within a minimum period of thirty (60) days following contract termination, provided that all required documentation, including the flight booking & cancelation flight ticket , refusal letter, has been received.

7 – PRICE ADJUSTMENTS

Prices may be modified depending on availability and supplier updates.

7.1 Organised Groups

Trip prices are calculated based on a minimum number of participants specified in the travel offer (generally 2 or 4 participants).
If the number of participants is lower, a small group supplement may be applied to ensure the departure of the trip. This supplement will be communicated no later than 30 days before departure.
If additional participants register later, the supplement will be refunded.

7.2 All Trips

All quotations remain valid for 14 days.
Prices may be revised due to changes in:

Traveler's will be informed of any price increase no later than 20 days before departure.
If the increase exceeds 8% of the total trip price, traveler's will have the option to accept or refuse the modification within a reasonable timeframe.

8 – SPECIFIC CONDITIONS OF OUR TRIPS

8.1 Accommodation

Unless otherwise specified, accommodation is provided in double occupancy rooms.
Twin rooms or single rooms may be requested subject to availability and may incur additional charges.

8.2 Organized Groups

The minimum group size is 2 participants, and the maximum group size is 14 participants.
The maximum number may be exceeded by one additional participant if the last registered traveler wishes to travel with a companion.
Services and travel conditions will remain unchanged.

9 – LIABILITY

AYURDESTINATION is responsible for the proper execution of services included in the contract and will assist travelers in case of difficulty.
Except in cases of personal injury, intentional misconduct, or negligence, any compensation will be limited to three times the total trip price.
AYURDESTINATION cannot be held responsible for external events such as:

AYURDESTINATION reserves the right to modify travel dates, schedules, or itineraries if necessary to ensure traveler safety.
If a planned itinerary cannot be completed, an alternative itinerary may be proposed using the unused funds from the original program. Additional costs may apply if the alternative itinerary is more expensive.
Refusal of the alternative itinerary will be considered a cancellation subject to the cancellation terms in Article 6.

Travelers must take full responsibility for any disruptions arising from such events. They are required to assess potential risks and make independent arrangements to manage them, as AYURDESTINATION shall not be liable for any resulting loss, damage, or inconvenience.

10 – PERSONAL DATA

Personal data collected through registration forms are stored in a computerized database managed by AYURDESTINATION.
To ensure proper execution of travel services, data may be shared with partners and suppliers such as hotels, transport companies, and technical service providers, including those located outside the European Union.

In accordance with applicable data protection regulations, travelers have the right to access, correct, delete, or transfer their personal data and to object to data processing for legitimate reasons.
